Registration as an entrant for the Healthcare x Digital 2023: Generative AI: Boosting Healthcare Pitch Event, a pitch event organized by the Event Organizers (the “Event”) is deemed to constitute acceptance of these terms and conditions. Terms and conditions may be amended at the discretion of the American Chamber of Commerce in Japan (the “ACCJ”), the ACCJ Healthcare x Digital initiative, i2.jp and various sponsors (collectively, the “Event Organizers”). Any and all amendments of terms and conditions will be posted on the website. Entrants participating in the Event (each an “Entrant”) agree to review terms and conditions periodically for amendments.

CONFIDENTIALITY

All Entrants selected that present on Pitch Day and/or Ideas Day are to present their ideas in a public forum, either virtually or in-person. All Entrants acknowledge that confidentiality is not guaranteed in any way at an event open to a variety of participants, and that they are solely responsible for excluding sensitive or confidential information from their pitches, applications and/or submissions. Non-Disclosure Agreements (NDAs) or similar arrangements between an Entrant and the judges, Event Organizers (hereafter including their employees and members), other event participants and/or audience members will not be required or allowed. Event Organizers, event judges, participating companies and their affiliates, and event participants assume no responsibility to ensure the confidentiality of any information contained in any presentation, pitch material, application and/or submission, and (ii) are not responsible for any confidentiality issues that may occur during the course of the competition, or thereafter, and will not be involved in any way with disputes arising therefrom.

PRIVACY

By submitting an application, each Entrant agrees to the organizer disclosing the applicant’s personal information to its sponsors, contractors and agents to assist in conducting the Event and communicating with Entrants.

PUBLICITY AND PROMOTIONAL ACTIVITIES

The oral presentation and awards ceremony portion of the Event is open to individuals and company representatives outside the control of the Event Organizers. Any and all of the public sessions may be broadcast to interested persons through promotion and media which may include print, radio, television, social media and the Internet. Any data or information discussed or divulged in the public session by Entrants should be considered information that will likely enter the public realm, and Entrants should not assume any right of confidentiality in data or information discussed, divulged or presented in this session. Further, each Entrant acknowledges and agrees that the information contained in any material submitted in connection with the Event, including descriptions of business concept, photos, videos, name and logo can be used in the public domain on the Event Organizers’ websites and all other forms of advertising. Winners consent to the Event Organizers using their business concept, photos, videos, name and logo in promotional materials.

INDEMNITY

Each Entrant agrees to indemnify and hold harmless the Event Organizers and the event judges from and against any liabilities, losses, claims, demands, costs (including legal costs) and expenses arising in connection with any breach or alleged breach by the Entrant of any representation, terms or conditions of registration or participation in the Event or any third party claims with respect to the Event.

DISCLAIMER OF LIABILITY

Event Organizers reserve the right to disqualify or remove at any time, in their sole judgment and discretion, any entry, individual or organization that violates the rules of the Event or is not aligned with the purpose of the Event. All such decision regarding an individual’s or team’s removal and/or disqualification from the Event are final. Event Organizers shall not be liable for any damage, loss or injury suffered by reason of an Entrant registering and participating in this competition. Event Organizers exclude liability for loss of income, loss of opportunity, personal injury and damage to property, whether direct or indirect, consequential or foreseeable due to some negligent act or omission or otherwise. Event Organizers accept no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. Event Organizers have no control over telephone communications, Internet communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. Event Organizers are not liable for any consequences of user error including (without limitation) costs incurred.

OTHER CONDITIONS

Entrants may incur costs while participating in this Event and are responsible for those costs, including but not limited to, travel and accommodation expenses. Entrants warrant and represent to the Event Organizers that they own all rights (including intellectual property) in the material they submit throughout the Event. The registration fee is non-refundable. Pitch presentation order will be determined by the Event Organizers prior to the competition. The maximum number of presenters shall be determined by the Event Organizers at their discretion. Event Organizers reserve the right to reduce the number of Entrants selected and designated as finalists at their discretion. Judges’ decisions are final.
